TERMS AND CONDITIONS OF SALE
NEW MERCHANDISE GUARANTEE:
When you place an order with Home Gallery, Inc., we submit a special order to the manufacturer on your behalf. All items ship brand new, direct from the manufacturer.
Clearance Store items may be factory-direct, cancelled, or returned items. Closeout items are ordered direct from the factory and have limited supply. All sales are final for Clearance Store and for Closeout items.
Home Gallery, Inc. accepts MasterCard, Visa, American Express, PayPal, BillMeLater, Google checkout, Money Order, Cashier’s Checks, Personal Checks and Wire Transfers. Payments entered via credit card, PayPal, BillMeLater, or Google checkout will be charged in full at the time of purchase. Payments via credit card provided over the phone can be split into two payments. Payments via personal check will not be submitted to the manufacturer until 10 business days from the date Home Gallery, Inc. deposits the check.
All orders must be paid in full upon receipt by our delivery company.
LIMITED WARRANTY FOR DAMAGE OR DEFECT:
Home Gallery, Inc.’s “Limited Warranty for Damage or Defect” guarantees that for in-home delivery service, we will restore or replace (at our expense and discretion) goods delivered incorrect, damaged, or defective, as long as you follow these instructions:
1. Note the incorrect model number, damage, or defect on the delivery paperwork at delivery.
2. Refuse incorrect, damaged, or defective goods at the time of delivery.
PLEASE NOTE, HomeGalleryStores.com WILL NOT restore or replace incorrect, damaged, or defective goods after the delivery team leaves. Damage or defect found after delivery CANNOT AND WILL NOT be attributed to the manufacturer or delivery company. Items shipped incorrectly will not be reordered unless the wrong item is returned at delivery. HomeGalleryStores.com cannot restore or replace incorrect, damaged, or defective goods at no charge to you if the issue is not reported at delivery.
Accidental transit damage, failed inspections, or incorrectly shipped items occur for 7-10% of the order we process, which is standard for the industry. It is the responsibility of the customer – and only the customer (or his/her agent accepting delivery) – to inspect merchandise upon delivery.
Home Gallery, Inc. requires that you completely inspect the order at the time of delivery. Inspect the top, bottom, left, right, front, back, interior, exterior, and all moving parts, including, but not limited to drawers, doors, and reclining mechanisms. You are required, as well, to inspect the assembly provided by our delivery partner.
Home Gallery Inc. does not warrant or guarantee assembly and is not responsible for damage to goods, personal property, or persons due to improper assembly. Our delivery partner will assemble the furniture, and any improper assembly must be addressed at the time of the delivery. As the customer accepting delivery, it is your responsibility to ensure that your order is assembled properly and you agree that you are responsible for issues that arise from improper assembly.
If your “Standard” shipping order arrives with damage, retain all packaging and report the damage or defect to both the carrier and Home Gallery, Inc. within 24 hours of the delivery. Home Gallery, Inc. will not be responsible for remedy, restoration, or replacement for incorrect items, damage or defects found after 24 hours of delivery. There are no exceptions to this rule.
If the order shows or develops a manufacturer defect after delivery and within the manufacturer’s warranty period, please contact Home Gallery, Inc. for assistance. The shipping cost for replacements is the responsibility of the consumer. Neither the manufacturer nor Home Gallery, Inc. is responsible for shipping costs associated with replacements for manufacturer defect.
If a Clearance Store or Closeout item arrives with damage or manufacturer defect, please follow instructions for our “Limited Warranty for Damage or Defect”, as described above. All sales are final for Clearance Store and Closeout items.
The purchaser agrees to allow up to 9 weeks for Home Gallery to provide a resolution for items that arrive incorrect or with damage or defect.
“White Glove” shipping:
The majority of our orders will ship via "White Glove” shipping. Our delivery partner will call you to arrange a delivery time prior to routing your order. Typically, our delivery partner will provide a two-day delivery window. Within one or two business days of delivery, you will receive a call to confirm a four hour delivery window.
The “White Glove” delivery service includes up to 30 minutes of in-home delivery, set-up, light assembly, and debris removal. Assembly time and use of tools varies by carrier. Please e-mail your salesperson for details pertaining to your order for assembly time and use of tools.
Our delivery partners will not connect, install, attach, or affix goods delivered to existing fixtures, walls, or furniture in your home. The following commonly requested services are not included in delivery set-up: hanging mirrors on walls, installing anything that attaches to a permanent fixture, assembly of cribs, attaching headboards to existing bed frames, or installation of adjustable wood/glass shelves.
The safety of our customers and our delivery drivers is of utmost importance. For this reason, the delivery drivers may or may not wear gloves or booties when making delivery. This will depend on the individual driver and the environment.
The customer – and only the customer (or his/her agent accepting delivery) –is responsible to measure doors, stairs and pathways to ensure the goods/furniture can be delivered into the home. Our delivery partners require 3” additional clearance around all sides of the goods delivered. At delivery, if the 3” clearance is not available, all goods will be delivered to the first dry area of the home, building, or business (i.e. lobby, garage, carport, etc.) If you must cancel or return an order because the items cannot be delivered to the home or the first dry area of the home, Home Gallery, Inc. will accept the returned/cancelled order in accordance with our return policy.
Orders sent via “Standard” shipping will be “drop-shipped” from the manufacturer or delivered by common carrier. The order will be delivered curbside or to your doorstep (depending on the shipper), and may or may not require your signature at the time of delivery. Items delivered via “Standard” shipping may require assembly by the purchaser.

You may require additional services to complete delivery. The services listed below are available to you for an additional fee and typical fees are provided. If your order and/or delivery incurs additional fees, you agree to pay the fees directly to our delivery partner, unless the payment of fees is discussed prior to the scheduled delivery time.

Deliveries may occur earlier or later than scheduled due to the nature of long-distance, nationwide shipping and unforeseen events. While we apologize for any inconvenience you experience, Home Gallery, Inc. is unable to offer compensation for inconvenience to you and/or deliveries that do not occur as scheduled.
Home Gallery, Inc. recommends some extra precautions to ensure a smooth delivery:
- Allow at least one hour buffer before and after the scheduled delivery time for unforeseen circumstances that would cause the delivery to occur earlier or later than scheduled
- Designate a friend or family member over the age of 18 to serve as a “back-up” to accept and inspect the delivery on your behalf, and make sure they understand what to do if the order arrives with damage
- Clear the room and all pathways to the room in which you would like the items to be delivered, and measure all doors and pathways to ensure your order fits into your home. For the goods delivered, allow 3" clearance on all sides through the pathways and doors.
- Take pictures of items that arrive with damage or manufacturer defect, as digital images are often required by the manufacturer
If our delivery partner confirms a delivery date, and you miss that confirmed date, you agree to pay 33% of your order total to cover the additional shipping fees incurred for a second delivery.
LOW PRICE GUARANTEE:
Our “Low Price Guarantee” states that if you find the same merchandise for a lower price within 30 days of your purchase, Home Gallery, Inc. will refund the difference between the two orders to you, as long as the order meets the following criteria:
- Order must be for the exact same item(s) and model number(s)
- Order must include the same delivery method and level of service
- Order must be from an online-only retailer (not a Brick & Mortar store or hybrid)
- Order must be from a Better Business Bureau accredited retailer
- Order must be brand new, factory-direct
- Order cannot be for a Clearance or Closeout item
Orders submitted for our “Low Price Guarantee” must be verified via a written quote from the competing online retailer.
CANCELLATION & RETURN POLICY:
Home Gallery, Inc. special orders all items from the manufacturer directly. Special orders are subject to a restocking fee, and in some cases, cannot be returned to the manufacturer. For this reason, Home Gallery, Inc. developed the following policy to address cancelled and/or returned orders.
Requests for Cancellation are not complete until confirmed in writing (via e-mail) by your Salesperson. Orders cancelled within 24 hours of purchase are not subject to a restocking fee unless the manufacturer has shipped the order. Orders cancelled after 24 hours of purchase and before contact from the Shipper are subject to a 25% restocking fee. The 25% Restocking Fee is calculated based upon the product subtotal less any discounts. Home Gallery, Inc. will calculate the refund amount by subtracting the 25% Restocking Fee from the Order Total with Sales Tax.
Home Gallery, Inc. will accept cancellations/returns with a 50% restocking fee on orders cancelled after the shipper contacts the purchaser, at delivery, or within 7 days of delivery. The 50% restocking fee is calculated based upon the product subtotal less any discounts. Home Gallery, Inc. will calculate the refund amount by subtracting the 50% Restocking Fee from the Order Subtotal with Sales Tax (the shipping fees paid by the purchaser, if any, will not be refunded).
The restocking fee covers administrative, shipping, storage, and all associated fees incurred during the processing and shipping of your order.
Home Gallery, Inc. will refund the Montage Protection Plan in full for orders cancelled or returned in full. If not all items are cancelled or returned on an order, Home Gallery will issue a prorated credit for the Montage Protection Plan. The prorated amount will be based upon the subtotal of the goods kept by the purchaser.

Returns for items with “Standard” shipping will only be accepted in the original packaging. Goods purchased with “Standard” shipping are subject to a 25% Restocking fee after 24 hours of purchase and a 50% Restocking fee at Delivery or after Delivery. The purchaser may or may not receive contact from the carrier before delivery.
All sales are final for Bedding; Custom Upholstery; Made-to-Order Casegoods, Outdoor Furniture, and Upholstery; Mattresses; Clearance and Closeout items. Final Sale items will not be accepted for return.
Returns requested for items in the home may take 4 – 6 weeks to process. This timeframe includes scheduling of pick-up, routing, and return to our delivery partner. Home Gallery, Inc. will issue the refund once returned goods are received and inspected. If items are picked up with damage, we will adjust the refund amount to restore the goods to 100%. We apologize for any inconvenience experienced to process a return.
To initiate the returns process, contact us by selecting from the Topics drop-down menu “Return Policy” at http://www.homegallerystores.com/contact_homegallery.shtml. Fill-out the form with the required information, OR Call Customer Service during regular business hours 9:00 a.m. to 6:00 p.m. Monday –Friday. Home Gallery, Inc. requires the purchaser to authorize the return by agreeing to the restocking fee and refund amount via e-mail.
A typical “White Glove” delivery will take 6 – 10 weeks to most areas. Custom and/or Made-to-Order furniture may take up to 16 weeks for delivery.
A typical “Standard” delivery will take 2 – 3 weeks to most areas.
Delivery timeframes may vary depending on availability and your location. All order confirmations will list the estimated delivery timeframe.
DISCLAIMER ON REPRESENTING GOODS, FINISHES & DISTRESSING
Home Gallery, Inc. offers thousands of products on our website. We do all that we can to provide the most accurate and complete product information. Home Gallery, Inc. is responsible to deliver all goods up to the Manufacturer’s Standards and Tolerances.
All items on our site are represented to the best of our ability. Customer’s purchasing online should be aware that there are several reasons an item may look different online than in person. Computer screens can distort color. Studio lighting is often very different from environmental or home lighting. Changes in production and/or factories can affect minor design features and the appearance of fabrics and/or finishes. Sunlight can fade or affect wood over time. Everyone interprets wood species, color descriptions, and color differently. For all these reasons, customers purchasing online should expect variation from the appearance of the item on our website to the appearance of the item in their home.
Many manufacturers use distressing techniques to enhance the character and appeal of furniture. While many items with distressing are factory produced, most distressing techniques are applied by hand and will vary in type, frequency, and lightness/heaviness from one piece to the next. The unique nature of distressing is what makes each piece one-of-a-kind. Customers purchasing goods with distressing should expect the item delivered to their home to be different from the items pictured on our website.
Please note, if Home Gallery, Inc. delivers the correct model number, and the item is up to the Manufacturer's Standards and Tolerances, orders cancelled or returned because the color or distressing was not what the customer expected will be subject to a 50% Restocking Fee. Please discuss any concerns and confirm your questions about the finish or distressing in writing with a Sales Representative before purchase.
RIGHT TO CANCEL:
Home Gallery, Inc. reserves the right to cancel any order for any reason, and we will offer a full refund if we choose to cancel your order.
DISPUTES, DEFAMATION & PARTIAL DELIVERIES:
In the event of a dispute of payment, charge back inquiry, or credit card dispute, Home Gallery, Inc. reserves the right to pursue legal recourse to recuperate expenses incurred to deliver orders, regardless of the bank or credit card company’s finding for the dispute. The purchaser agrees to allow up to 9 weeks for Home Gallery to provide a resolution for items that arrive incorrect or with damage or defect. If Home Gallery, Inc. wins in court, the customer agrees to pay the sale price of the goods, plus any additional shipping incurred by Home Gallery, Inc., plus all collection and attorney’s fees associated with the collection and/or legal process.
If the customer defames Home Gallery, Inc. with untrue or incomplete information in public reviews, to credit card companies, or to the Better Business Bureau, Home Gallery, Inc. reserves the right to recuperate all damages caused by the customer.
If Home Gallery cannot restore or replace an item, Home Gallery will issue a refund for that item. If the item was purchased as part of a set, Home Gallery will issue a refund for any item that we cannot restore or replace. If the customer would like to return items from a set because Home Gallery cannot restore or replace an item in a set, the customer agrees to the return with a 50% restocking fee.
In cases of payment dispute, charge back inquiry, or credit card dispute, if items delivered free from damage or defect are included in the amount in dispute, Home Gallery will consider the goods delivered to be a theft of Home Gallery property. If and when the dispute is settled in favor of the purchaser, and Home Gallery will pursue legal action for the theft of Home Gallery property.

Home Gallery, Inc. makes no other express or implied warranties, including implied warranties of merchantability or fitness. Home Gallery, Inc. offers the “Limited Warranty for Damage or Defect” and "Cancellation & Return Policy" as our sole obligation and exclusive remedy. Home Gallery, Inc. is not liable for any incidental or consequential damage.

Although nationwide deliveries of quality furniture presents challenges, only a small percentage (7 – 10%) of orders experience defect, damage, and/or delays.
